Resolution to Support Immigrant Students & Condemn Federal Immigration Policies
WHEREAS, The San Diego State University Associated Students (the “Associated Students”) is a California non-profit public benefit corporation and student body organization and auxiliary organization of The San Diego State University subject to, among other laws, California Corporations Codes sections 5110, et seq., and California Education Code sections 89300, et seq. and 89900, et seq; and
WHEREAS, Associated Students is committed "to support the mission of San Diego State University to create, promote and fund social, recreational, cultural, and educational programs and facilities both on campus and in the community, advocate for student interests, provide leadership opportunities and participate in shared governance" 1; and
WHEREAS, San Diego State University, with campuses in central San Diego County, the Imperial Valley, and Oaxaca, is the only CSU whose service area spans the entire California–Mexico border region. As a result, SDSU serves a large population of immigrant and binational families for whom cross-border movement is a regular part of daily life; and
WHEREAS, the California State University (CSU) system enrolls nearly 10,000 undocumented students across its 22 universities2, and that SDSU is home to many undocumented and mixed-status students who are essential to our campus community and are impacted by unique challenges due to their immigration status; and
WHEREAS, San Diego State University, as an institute of higher education, bears an ethical and civic obligation to protect the holistic wellbeing, inherent rights, and dignity of every member of their campus community. As a University holding both HSI and AANHPISI designations, San Diego State has an elevated obligation to shield their campus community from federal policies that create a culture of fear and anxiety; and
WHEREAS, the presence and actions of federal immigration agencies, whether through direct enforcement or the threat thereof, impacts students ability to fully participate in academic life, access campus resources, and engage in constitutionally protected activities such as free speech and peaceful protest. These impacts are felt by students regardless of whether that student is documented, undocumented, an international visa holder or from a mixed-status family — which undermines the core educational mission of public universities3 and
WHEREAS, immigrant students face unique vulnerabilities, including: the constant fear of deportation or family separation, no access to federal financial aid or healthcare, limited access to state financial resources, and the mental health toll of living under chronic uncertainty. These challenges can negatively impact students’ academic performance and well-being4.
WHEREAS, ICE detention and enforcement practices have violated principles of due process and fundamental human rights5. Including detaining individuals without timely access to legal counsel, subjecting them to prolonged confinement, and denying adequate medical care6 — conditions that have caused significant harm to impacted communities and have been linked to the deaths of 32 individuals in 20257 and
WHEREAS, federal immigration agencies have a documented history of conducting actions that result in family separation, prolonged detention, and the targeting of immigrant communities, practices that have caused widespread fear, trauma8, and instability among undocumented individuals and mixed-status families, including students within the CSU system and SDSU community.
Therefore it be resolved that
RESOLVED, Associated Students, stands in solidarity with immigrant, mixed-status and undocumented communities and affirms Associated Students role as a place of education, access, and advocacy for all and Associated Students formally condemns the actions of the Federal Immigration agencies for their acts of violence and disregard for human rights, civil liberties and due process and therefore calls for the abolishment of the Immigration and Customs and Enforcement Agency; and be it further
RESOLVED, Associated Students acknowledges the unique burden in which our undocumented students, international students, and students from mixed status families face both mentally and financially and therefore calls on SDSU to:
- Empower University Relations and Development to pursue community-sourced funding opportunities that expand scholarship support for undocumented students, international students and those from mixed-status families
- Ensure accessible financial aid education and assistance tailored to the unique needs of undocumented students, international students and students from mixed-status families
- Expand access to emergency financial support for undocumented students, international students, and students from mixed-status families; and be it further
RESOLVED, Associated Students calls on SDSU to facilitate in-person, mandatory UndocuAlly Training with specific training details on how to facilitate aid for immigrant students in their respective departments, including but not limited to: Employees in the office of Basic Needs, Financial Aid, Housing and Residential Education, Counseling and Psychological Services, and Coordinated Care Advisors. Additionally, all full time SDSU Faculty and Staff as well as Aztec Shops employees shall be mandated to complete UndocuAlly training via an online Canvas module to be developed by the Monarch Unity Resource Center; and be it further
RESOLVED, Associated Students urges the university administration to extend flexibility and understanding to students facing challenges related to attendance, commuting to campus, housing, and other circumstances during this difficult period; to foster a culture of empathy and therefore Faculty and staff shall provide resources which allow students to conduct academic responsibilities in an alternative method when a student has an apparent threat of enforcement action while ensuring FERPA compliance; and be it further
RESOLVED, While Associated Students acknowledges the guidelines set by SB 98, The Associated Students calls upon SDSU to develop and implement clear notification procedures to students, faculty, and staff beyond the minimum standards legally mandated by SB 98. Specifically, if federal immigration agencies are present and conducting enforcement activity within a 1 mile radius of campus, SDSU shall coordinate with SDPD to send notification of said enforcement activity, recognizing that enforcement activity in surrounding neighborhoods where many students reside has an equal and direct impact on the safety, well-being, and sense of security in the university community; and be it further
RESOLVED, Associated Student also formally acknowledges the work and resources already provided by the Monarch Unity Resource Center. For students looking for support, or to be involved in advocacy and ally efforts on campus, we share the following resources:
- Monarch Unity Resource Center, which offers academic and career advising, legal services, assistance with DACA renewals, immigration legal consultation, mental health workshops, guidance and support in navigating campus and community resources, and more.
- San Diego State CARES team, which offers support for students facing significant concerns in relation to their well-being.
- Counseling and Psychological Services, which offers a wide range of services to help students obtain support through individual counseling, couples counseling, group therapy, and more.
- Associated Students External Relations Board, which is tasked to develop and execute appropriate courses of action to ensure the student perspective is represented at the local, statewide and federal levels of government and to recommend policy positions to Associated Students.
RESOLVED, that Associated Students of San Diego State University shall exercise its ability to disseminate this resolution, condemning the acts of U.S. federal immigration agencies, through the means of but not limited to; social media, California State University Associated Students organizations, President de la Torre, The California State Student Association, The CSU Chancellor’s Office.
