A Resolution of the AS Authorizing Worker's Comp. Insurance Coverage for AS of SDSU Volunteers
WHEREAS, from time to time volunteers provide various types of services to the ASSOCIATED STUDENTS OF SDSU
WHEREAS, except for certain statutory exceptions, volunteers are not covered by the ASSOCIATED STUDENTS OF SDSU worker’s compensation insurance coverage if they are injured as a result of such volunteer services;
WHEREAS, Labor Code Section 3363.6 provides that a private, nonprofit organization may declare its volunteers as employees for worker's compensation insurance purposes by adopting a resolution authorizing such coverage.
NOW, THERE FORE, THE BOARD OF DIRECTORS FOR THE ASSOCIATED STUDENTS OF SDSU HEREBY RESOLVE AS FOLLOWS:
Section 1. Pursuant to Labor Code Section 3363.6, the Board of Directors for the ASSOCIATED STUDENTS OF SDSU does hereby declare that any person who performs voluntary service without pay for the ASSOCIATED STUDENTS OF SDSU shall be deemed to be an employee of the ASSOCIATED STUDENTS OF SDSU for worker's compensation purposes, provided the volunteer services are authorized by the ASSOCIATED STUDENTS OF SDSU Board of Directors.
PASSED AND ADOPTED by ASSOCIATED STUDENTS OF SDSU Board of Directors at a regular meeting held on September 22, 2004 by the following vote: AYES: Passed Unanimously
