ARTICLE VII    CODE OF ETHICS

Section 1 Background
1.01 The students of San Diego State University, as members of the Associated Students, are entitled to have complete confidence in the integrity of the student government. Each elected official, officer, appointee, full-time manager and employee with budgetary responsibility of the Associated Students must help to earn that confidence by his/her own integrity and conduct. Section 2 Purpose
2.01 The purpose of this Code is to adopt a Code of Ethics setting standards of conduct for all elected officials, officers, appointees and employees of the Associated Students. This policy is not intended to supersede, negate or otherwise invalidate any applicable section of Title V, other State law, campus or Trustee policy or established personnel policy.

It is the policy of the Associated Students that the following Code of Ethics be adopted for all elected officials, officers, appointees, full-time managers and employees with budgetary responsibility of the Associated Students of San Diego State University.
  1. No elected official, officer, appointee, full-time manager and employee with budgetary responsibility of the Associated Students shall engage in any business or transaction or shall have a financial or other personal interest, direct or indirect, which is incompatible with the proper discharge of higher official duties or that would tend to impair his/her independence or judgment or action in the performance of such duties.
  2. No elected official, officer, appointee, full-time manager and employee with budgetary responsibility shall engage in any enterprise nor activity, which shall result in any of the following:
    1. Using the prestige or influence of A.S. office or employment for private gain or advantage of himself/herself or another.
    2. Using time, facilities, equipment or supplies of the Associated Students for the private gain or advantage of himself/herself or another.
    3. Using official information not available to the general public for his/her private gain or advantage or that of another.
    4. Receiving or accepting money or other consideration from anyone other than the Associated Students for the performance of acts done in the regular course of employment or duties.
    5. Receiving or accepting, directly or indirectly, any gift or favor from anyone doing business with the Associated Students under circumstances from which it could be reasonably inferred that such was intended to influence him/her in his/her official employment or duties, or as a reward for official action.
    6. Engaging in or accepting private employment or rendering services for private interests when such is incompatible with the proper discharge of his/her official employment or duties.
    7. Directly or indirectly engaging in any activity or entity which competes with the existing, planned or potential business activities of Associated Students.
    8. Owning any ownership interest either directly or indirectly in an entity which supplies goods or services to the Associated Students; provided, however, that stock ownership in a publicly traded corporation shall be permitted if the ownership does not exceed five percent of the outstanding stock of the corporation.
  3. Every official, officer, appointee, full-time manager and employee with budgetary responsibility of the Associated Students shall disclose completely the nature and extent of any interest, direct or indirect, which conflicts with his/her responsibility or duty.
  4. Some of the business information of the Associated Students may be public but the timing and breadth of the dissemination of that information to the public, if it occurs at all, most often lags awareness by the AS Council and/or its management. Therefore, because the AS Council or management member could obtain a benefit not available to the general public, a transaction involving that information would be considered a conflict of interest.
