ARTICLE IV LEGISLATIVE PROCEDURES CODE and

Legislative Procedures |
| 1.01 |
Procedures
Any legislation to be approved by the A.S.
Council shall be submitted to the A.S. Government Affairs Office by
the sponsor of the legislation. |
| 1.02 |
Any legislation to go to the A.S. Council must be submitted by 10:00
a.m. on the Thursday before the A.S. Council meeting for which it is
to be reviewed as information. |
| 1.03 |
New legislation shall be assigned a legislative number by the A.S.
Government Affairs Office and placed upon the Agenda. |
| 1.04 |
All legislation shall first be reviewed by A.S. Council as an information
item and voted upon as an action item at a later meeting, except as
provided for in Section 1.07, below. (Revised 11/20/02) |
| 1.05 |
Legislation shall not be acted upon by the A.S. Council until it
has been reviewed by the appropriate boards or committees, if such review
is deemed necessary by A.S. Council. (Revised 4/13/05)
- The AS Council shall not entertain a resolution which has not first
been recommended to it by a lower board or committee. Resolutions
shall be addressed to a lower board or committee as they pertain to
the duties of each board or committee.
- Resolutions that come before AS Council shall be accompanied by
a summary of findings and written testimony by a member of the lower
board or committee that recommended the resolution to AS Council.

| 1.06 |
For the purposes of this Code, the following definitions shall apply:

Sponsor
The Sponsor of legislation is the
A.S. Council member who is introducing the legislation.

Legislation
Any resolution, bylaw amendment,
charter or charter amendment, code, Executive Order, or standing rule
which shall be voted upon by A.S. Council.

Legislative Number
A coded number assigned each act
of legislation when it is introduced to A.S. Council.

Special Rules of Consideration (Added 11/20/02)
- The special rules of consideration outlined in Section 1.07 shall
be utilized by the A.S. Council for all legislative matters that meet
any or all of the following criteria:
- any legislative matter submitted directly to the Council without
having first been presented for recommendation from an appropriate
A.S. board or committee.
- any legislative matter submitted for consideration of the A.S.
Council by the External Affairs Board.
- any legislative matter submitted for consideration of the A.S.
Council by the University Affairs Board.
- any matter submitted for consideration of the A.S. Council that
involves an expenditure of funds in excess of $1 million.
- All legislative matters submitted to the A.S. Council that meet
one or more of the criteria outlined above in Section 1.07(a), will
be automatically suspended and subject to the following additional
special rules of consideration:
- the legislative matter before the A.S. Council must be posted
in written form in a location accessible to the general public no
less than 3 weeks prior to the final action by the A.S. Council,
and
- prior to final consideration by the A.S. Council , the sponsor
of the legislative matter must arrange for a minimum of two public
hearings on the proposed legislative matter, public notice of which
is to be provided via flyers and/or advertisements in the Daily
Aztec, and
- all public notices for the legislative matter before the A.S.
Council must include notice of and provisions for receiving electronic
testimony regarding the proposed legislative matter, and
- prior to the final consideration by the A.S. Council, the proposed
legislative matter shall be docketed on the agenda for a minimum
of two regular meetings of the A.S. Council, for the purpose of
receiving public testimony on the proposed legislative matter.
- Exceptions to or a waiver of these special rules of consideration
shall only be made upon the approval of a ¾ (three-fourths) majority
of the A.S. Council.

| Section 2 |
Provisions for Public Comment |
| 2.01 |
The public at-large shall be given the opportunity to be heard on
any item before or during consideration of the item by the A.S. Council. |
| 2.02 |
The Rules Committee, with the approval of A.S. Council, shall establish
reasonable procedures to receive requests for communication for A.S.
Council by the public at-large using the following guidelines:
- For items docketed for consideration by the A.S. Council, the A.S.
Council Secretary shall at the beginning of each meeting, distribute,
collect and submit to the A.S. President, written communication request
forms from any member of the public who wishes to speak on a particular
item.
- For items not currently docketed for consideration by A.S. Council,
but for which a member of the public wishes to communicate with the
A.S. Council on a certain date, a written communication request shall
be made available for submission to the A.S. Council.
- Requests to speak before the A.S. Council shall be limited to five
minutes and be limited to matters, which are proper areas for discussion
or action by the A.S. Council.

Rules Committee (Revised 5/17/95) |
| 3.01 |
Purpose
- The purpose of this Committee shall be to assist the A.S. Parliamentarian
and the A.S. Council in the maintenance, the updating, and the interpretation,
of the internal structural policies of the Associated Students.
- The purpose of this Committee shall also be to review any grievances
or complaints brought against any member of any A.S. Council member
or board member with exception of A.S. Employees, regarding ethics,
misconduct, or these Bylaws.

Membership (Revised 11/18/98)
- The Committee shall consist of nine (9) voting members to include
the President Pro Tempore, A.S. Executive Vice President, three (3)
members of the A.S. Council, and four (4) student-at-large members
to be appointed at the beginning of the Fall semester. (Revised 11/18/98)
- The interview committee to fill the four (4) student-at-large seats
shall be comprised of the President Pro Tempore and the Executive
Vice President or his/her designee. (Revised 11/18/98)
- There shall be additional ex-officio, non -voting members of the
committee to include the following:
- A.S. Parliamentarian
- A.S. President or designee
- University V.P. of Student Affairs or designee
- A.S. Executive Director or designee

Meetings (Revised 4/17/02, 12/03/03)
- The President Pro Tempore shall serve as the Chair of the Rules
Committee.
- The Vice Chair shall be elected by the Rules Committee at the beginning
of the fall semester and shall act as the interim Chair in the absence
of the President Pro Tempore.
- TThis Committee shall meet when necessary, but shall meet at least
weekly unless otherwise announced during the semester.
- Any appointed member of the Committee who misses two (2) of any
ten (10) consecutive meetings, without being excused shall be dropped
from the Committee. Absences may be excused only by the President
Pro Tempore.

Responsibilities
- Rules Committee shall assist the A.S. Parliamentarian with respect
to the efficient functioning of the A.S. Council meetings and the
bureaucratic structure of the Associated Students.
- Rules Committee shall make sure that the flow of information regarding
Parliamentary Procedure, Bylaws, Board Charters, Codes and other internal
structural policies of the Associated Students to the A.S. Council
is adequate and shall include up-to-date filing of information and
periodic reports to the A.S. Council.
- Rules Committee shall review all Bylaws, Board Charters, Codes,
and other internal-structural policies of the Associated Students
and make recommendations to the A.S. Council regarding revision, amendments,
or adherence (or lack of it). Any revisions, amendments, or grievances
regarding the Bylaws, Board Charters, Codes, or other internal-structural
policies of the Associated Students must first be submitted to the
Rules Committee by the deadline stipulated by the Rules Committee
at the end of the previous semester before it can be considered by
the A.S. Council. (Revised 11/19/97)
- Rules Committee shall receive any and all grievances or complaints
brought against any A.S. Council member or Board member with the exception
of A.S. Employees, except those grievances dealing with the Elections
Code. If Rules Committee determines that the grievance or complaint
could be better served by another committee it shall refer the matter
to that committee for a recommendation.
- Rules Committee shall respond to any grievances or complaints brought
against any A.S. Council member or Board member with the exception
of A.S. Employees, by reviewing the case and making a recommendation
to the Executive Committee for approval. (Revised 5/17/95)
- The Rules Committee shall create and maintain a “Director Agreement
Concerning Confidentiality, Access to Proprietary Information, Liability
of Directors, Eligibility to Serve and Required Duties & Responsibilities
and Conflict of Interest,” which must be signed by each newly elected
or appointed voting member of A.S. Council prior to the member participating
in any A.S. Council affairs. (Revised 4/26/00)
- The Rules Committee shall ensure that each newly elected or appointed
voting member of A.S. Council has signed the Director’s Agreement
referred to in subsection (f), above. (Revised 4/26/00)
- The Rules Committee shall have the responsibility to receive and
hear any complaint that a Council Member has violated or breached
any provision of the Director’s Agreement referred to in subsection
(f), above, as well as any complaint of violations by any voting member
of the Bylaws, the Standing Committee Codes or the Code of Ethics
as provided for in Section 3 of Article VI of the Standing Committee
